Your fee agreement for an attorney's services should set out what the lawyer will provide for you, the type of fees, and the amount you will be expected to pay. The lawyer's bills should include details of the services provided, along with an itemization of costs.

Legal Malpractice - An Overview

When people are involved in situations where their legal rights may be affected -- whether after a car accident, during divorce proceedings, or when handling a business transaction -- more often than not they look to an attorney for help. In most cases, an attorney is an invaluable asset to his or her client, serving to protect their legal rights and representing their interests in the matter at hand. Unfortunately, situations do arise where an attorney fails to live up to what their client bargained for in seeking legal representation, and ultimately the attorney has not adequately served the client's interest. Under these circumstances, the attorney may be liable to the client for legal malpractice.

Understanding Lawsuits

The procedure of a lawsuit is unfamiliar to most people, and for that reason what you might see as wrongdoing by your lawyer is really something to be expected, or at least something not out of the ordinary in handling a civil suit. Any lawsuit is a complicated process, and it can be full of unpleasant surprises and frustrating delays. Remember that there are at least two parties to every action, so the schedule and events that take place can be out of your hands, and in some instances out of your lawyer's hands as well.

Fee Agreements & Disputes

A common complaint from clients is that they never know what to expect in terms of payment for their lawyer's legal services, and do not understand their options if they disagree with something that occurs in the payment process. Much of the confusion over legal services can be avoided through an understanding of the fee agreement process and what a typical fee agreement will cover. Following are a few helpful guidelines on how a fee agreement with a lawyer will generally work, and what you can do if a dispute arises over the agreement.

Common Sources of Malpractice Claims

Unfortunately, lawyers don't always get the results for their clients that the clients had hoped for. Sometime, there is nothing more that the attorney could have done-there are no guarantees in our legal system. In many cases, however, the attorney either did something wrong, or failed to do something he or she should have done. In those cases, the attorney may be liable for legal malpractice.

In order to hold an attorney liable for malpractice, you must first show that the attorney's performance was not up to professional standards. Next, you must show that the failure to meet those standards caused you some harm: you lost your case, or the result you got was not as good as it should have been. It is not always easy for the average person to determine if he or she has a legal malpractice claim. An attorney with experience in bringing legal malpractice claims can help you determine if you have a claim for legal malpractice.

Frequently Asked Questions about Legal Malpractice

Q: My lawyer originally said my case was worth over six figures, and now she's telling me I should settle for a few thousand dollars. Can I sue her for the difference?

A: No. Your lawyer may have given you an inflated estimate of the value of your case to encourage you to hire her, or the strength of your case may have changed for certain reasons. If you feel that something doesn't add up, you can get your file from your lawyer and get a second opinion from another lawyer.

Q: I found my lawyer through a newspaper ad, and I'm starting to wonder if that was a good idea. Are advertisements a good place to look for a lawyer?

A: Ads can be useful in finding a lawyer, but be careful about believing everything you read and hear. Newspaper, telephone directory, radio, and television ads can make you familiar with the names of lawyers who may be appropriate for your legal needs. Keep in mind that the lawyer may not be a "specialist" in the advertised field, and that your case may not have a simple solution. If a lawyer quotes a fee, be certain you know exactly what services the charge does and does not include.
